HEARING PANEL DECISION
DIVISION OF ENFORCEMENT v.
LORI OGET
Exchange Hearing Panel Decision
02-129
June 18, 2002,
Hearing Officer ---
Milton M. Stein

SOURCE CITE

NYSE Rule 440
'34 Act Rule 17a-3
'34 Act Rule 17a-4

Operations Manager entered personal trades into firm's error account. Censure and 4 year bar.

Stipulation of Facts and Consent to Penalty. Oget was a non-registered operations manager of Gruntal & Co. LLC's Cypress Creek, Florida branch office.  Among her duties, she processed trade corrections.  On five occasions, Oget initially entered trades in her personal accounts and subsequently used trade corrections to transfer such orders to one of Gruntal's error accounts.  In each of these trades, Oget sold the securities from the error accounts, resulting in losses.  On at least two occasions, Oget both purchased and sold positions from an error account, resulting in losses.  Net losses to Gruntal's error accounts was $2,733.17.  The trades at issues rendered Gruntal's books and records inaccurate because they falsely represented Oget's personal trades as "errors," in violation of NYSE Rule 440,  and '34 Act Rules 17a-3; -4.  Similarly, her conduct was inconsistent with just and equitable principles of trade, in violation of NYSE 476(a).

The Hearing Panel censured her and barred her for four years in all capacities.
